Welcome to www.rachscakes.co.uk (the ‘site’ or ‘website’).

By using this site you are agreeing to follow and abide by our terms and conditions and privacy policy. Throughout these terms, we will refer to ourselves as ‘rachscakes.co.uk’, ‘Rach’s Cakes’, ‘us’, ‘we’ or ‘our’.

We may revise the Terms and conditions and Privacy Policy at any time without notice to you.

1. Prices & Description of Goods
All prices are correct as stated on the website, however we reserve the right to revise the price of goods at any time, without notice. The content of this website has been carefully prepared to ensure all goods have been described properly. However, goods may differ slightly to those described, i.e – weights, sizes and dimensions are approximate and may vary slightly.

2. Minimum and Maximum orders
Our minimum order for each product is specified on the corresponding website page. There is no maximum order amount. 

3. Availability of Goods
Orders are subject to acceptance and availability. If for any reason the product/s you have ordered are not available on that day, we reserve the right to substitute a different item. For example, if a flavour you have chosen is unavailable we may substitute it for another flavour. We will contact you prior to collection/delivery to discuss any substitutions.

4. Payment
For all products except our 'Letterbox Brownies', we only accept payment by bank transfer or PayPal. For 'Letterbox Brownies', you can order and pay online directly from the Letterbox Brownie page.

5. Delivery charges and service
For our 'Letterbox Brownies', free delivery via courier is available to UK mainland addresses. (An additional charge may be incurred for some postcode areas, including the Scottish highlands and islands. Any additional postage charges will be displayed prior to you confirming your order.) For everything else, free delivery is available within the following postcodes: WR1, WR2, WR3, WR4, WR5. A delivery charge is available upon request for addresses outside of these postcodes. 

6. Postal Dispatch & Delivery
Our aim is that all orders received by 6pm get dispatched the following working day. Standard delivery is 2 working days. Once your order has been dispatched, you will receive regular email updates as to the whereabouts of your goods. Please ensure the delivery information and contact details you give us at checkout is correct. We cannot accept any liability for incorrect/ incomplete addresses. An incorrect/ incomplete address could delay / prevent delivery. Orders at peak periods for postage (e.g. Christmas, Easter, Valentines Day etc. ) may carry a greater risk of delay therefore we would advise that you allow more time for your delivery during these periods. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or damage. Suggested storage instructions are included with all products. 

7. Contract
All products except 'Letterbox Brownies' - a deposit is required to secure all bookings. Full payment is required one week prior to collection/delivery date. By paying for the goods, you are committing to a purchase. Our acceptance of your order completes the contract between us. For 'Letterbox Brownies', full payment is made online at the time of purchase.

8. Risk and ownership
Letterbox Brownies - Rach’s Cakes cannot accept any responsibility for the condition of the postal box or its contents once it has been dispatched. All other products - Rach’s Cakes cannot accept any responsibility for the condition of the goods once delivery / collection has been completed. Goods supplied are not for resale.

9. Cancellation rights
'Letterbox Brownies' - The Distance Selling Regulations state that consumers DO NOT have the legal right to cancel orders of made-to-order items. However, Rach’s Cakes WILL accept cancellations only if the cancellation is requested prior to the product being dispatched. Once the product has been dispatched, cancellation will not be possible. 

For everything else, cancellation is required 2 working days prior to the intended collection / delivery date. Cancellations are required in writing and will need to be sent to our email address info@rachscakes.co.uk

10. Cancellation by us
We reserve the right to cancel the contract between you and us if:

· We have insufficient stock to deliver the goods you have ordered

· We do not deliver to your area (delivery is within the UK only)

· One or more of the goods you ordered was incorrectly listed due to a typographical error or an error in the pricing information

If we do cancel your contract we will notify you by e-mail and will refund any payment you have made to us within 30 days of your order.

11 Liability
11.1 Letterbox Brownies - If you or the intended recipient do not receive goods ordered by you within 7 days of the date for which you ordered them, we will have no liability to you unless you notify us in writing at our contact email address of the problem within 3 days of the intended delivery date.

If you notify a problem to us under this condition, our only obligation will be, at your option:

· To send a new box at our earliest convenience;

· To refund to you the amount paid by you for the goods in question in whatever way we choose.

Both parties shall only be liable under this contract for losses, which are a reasonably foreseeable consequence of the relevant breach of contract.

11.2 As our letterbox brownies fit through a standard UK letterbox, it is possible for the box to be chewed by dogs/cats/other pets. Chocolate is very harmful to pets if ingested. We have clearly stated this information on our letterbox brownies web page and ask customers to consider this information before sending a box to a household with pets. Rach’s Cakes will not be liable for any harm caused to pets through ingestion of postal brownies.

You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. The importation or exportation of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.

Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

12. Notices
Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and sent to us by email to info@rachscakes.co.uk
All notices from us to you will be displayed on our website from time to time.

13. Changes to legal notices
We reserve the right to change these terms and conditions infrequently and you should read through them periodically.

14. Invalidity
If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.

15. Privacy
You acknowledge and agree to be bound by the terms of our privacy policy (see 21 below)

16. Third party rights
Nothing in this Agreement is intended to, nor shall it confer any rights on a third party.

17. Jurisdiction
These terms and conditions will be governed by the laws of England and Wales and by using this website you agree to submit to the exclusive jurisdiction of the courts of England and Wales.

18. Intellectual property
All of the content on the site, including text and pictures, are subject to copyright and other intellectual property rights held by ‘Rach’s Cakes’. The entire content of the site is copyrighted under applicable copyright laws.

The use of our site and it’s content is intended for the personal and non- commercial use by the users of our site.

19. Use of the site
You may view, download and print documents and graphics from our website including our Terms & Conditions and Privacy Policy, provided that: (a) (The Documents) may be used solely for personal, informational and non-commercial purposes; and (b) (The Documents) may not be modified or altered in any way.

You may not otherwise use, download, upload, copy, print, display, perform, reproduce, publish, license, post, transmit or distribute any information from this website in whole or in part without the express authorisation of ‘Rach’s Cakes’. All images on the website are the property of ‘Rach’s Cakes’ and may not be used for commercial purposes without explicit written permission from ‘Rach’s Cakes. ‘Rach’s Cakes’ reserves complete and full intellectual property rights in any content you download, print, reproduce, distribute or store from this website.

20. Cyber Security
We always try to ensure that our website is free from viruses or defects. However, we cannot guarantee that your use of this website or any websites accessible through it will not cause damage to your computer. It is the responsibility of the consumer to ensure they have the right equipment/software to use the website. We will not be liable for any loss or damage which may arise to computer equipment as a result of using this website, unless as a result of our negligence.
